Courthouse Gallery & Studios (CHG&S) Ticket Sales - Terms and Conditions
By purchasing a ticket for an event at the Courthouse Gallery & Studios (CHG&S), you agree to the following terms and conditions. Please read these carefully before proceeding with your purchase.
1. About the Courthouse Gallery & Studios (CHG&S)
- The Courthouse Gallery & Studios (CHG&S) is operated by Old Ennistymon Heritage Ltd, a not-for-profit community arts organization. CHG&S serves as a venue for a wide variety of events, many of which are organized by external individuals or entities who rent the space.
2. Ticket Purchase and Event Responsibility
- CHG&S is responsible solely for processing ticket sales for events held at its venue. Many of these events are organized and managed by third-party event organizers who hire CHG&S as a venue. The event organizer is solely responsible for the event’s content, schedule, and management.
- In cases where the event is produced by an external organizer, the event organizer is solely responsible for any refunds in case of cancellation or significant changes. CHG&S will assist with communication but is not responsible for issuing refunds for third-party events.
- For CHG&S-organized events, if the event is canceled or rescheduled, CHG&S will offer a full refund or, in the case of postponement, the option to transfer tickets to the rescheduled date.
- For inquiries regarding event specifics, including event content, lineup, timing, or cancellations, please contact the event organizer directly. CHG&S will provide the event organizer’s contact information upon request.
3. Event Cancellation, Changes, and Refunds
- All ticket sales are final. Refunds will not be issued unless the event is canceled or postponed by the event organizer or CHG&S.
- If an event organized by CHG&S is canceled, you will receive a full refund via the original payment method. If the event is rescheduled, your ticket will be valid for the new date, or you may request a refund within [X days] of the rescheduling notice.
- For third-party events, CHG&S will assist in communicating cancellations and changes, but all refund and compensation requests must be handled directly with the event organizer. CHG&S does not guarantee refunds for events organized by third parties.
- Partial cancellations (such as lineup changes) will not be eligible for refunds unless a significant portion of the event is canceled. For CHG&S events, partial refunds may be issued at the discretion of CHG&S.
4. Ticket Transfer, Resale, and Fraud Prevention
- Tickets purchased through CHG&S are non-transferable unless explicitly permitted by the event organizer.
- The resale of tickets for profit is prohibited under Irish law. Any tickets found to be resold above face value may be voided, and the ticket holder may be refused entry.
5. Entry Requirements, Refusal of Entry, and Conditions
- All attendees must present a valid ticket to gain entry to the event. Entry is subject to the venue’s capacity limitations and safety regulations.
- CHG&S reserves the right to refuse entry to any ticket holder or attendee if it deems necessary to protect the safety, comfort, or well-being of event participants, staff, or volunteers, or to ensure compliance with venue rules and regulations. Reasons for refusal may include, but are not limited to:
- Intoxication
- Inappropriate behavior
- Non-compliance with health and safety regulations
- Possession of prohibited items (such as glass containers or outside food and beverages)
- No refunds will be provided to ticket holders who are refused entry or removed from the venue due to non-compliance with the rules or inappropriate behavior.
- Strict No-Glass Policy: CHG&S enforces a strict no-glass policy inside the venue. For safety reasons, all beverages must be in plastic or other non-breakable containers.
- No Outside Food or Drinks: Outside food and beverages are not permitted at CHG&S unless explicitly allowed by the event organizer. Concessions may be available on-site.
6. Photography, Filming, and Media Usage
- By attending an event at CHG&S, you agree that photography, video, and audio recordings may be taken during the event by CHG&S, the event organizer, or approved third parties.
- CHG&S retains the right to use photography and video taken at events for promotional purposes. These recordings may be published on websites, social media, or other platforms.
- Attendees who do not wish to be photographed or filmed should notify event staff upon arrival. However, CHG&S cannot guarantee complete exclusion from media captured in public areas.
- Unauthorized use of professional photography, video, or audio recording equipment is prohibited unless approved by the event organizer or CHG&S.
7. Liability Waiver, Indemnification, and Limitation of Liability
- Waiver: CHG&S, Old Ennistymon Heritage Ltd, its staff, volunteers, and affiliates shall not be held liable for any personal injuries, property damage, or losses incurred by attendees during the event. Attendees assume all risks related to attending the event and entering the venue, including but not limited to slips, falls, accidents, or damages.
- Indemnification: By attending the event, attendees agree to indemnify and hold harmless CHG&S, Old Ennistymon Heritage Ltd, its staff, volunteers, and affiliates from any and all liabilities, claims, damages, and expenses (including legal fees) arising from attendance at the event or any actions, negligence, or omissions of the attendee.
- Limitation of Liability: In no event shall CHG&S, Old Ennistymon Heritage Ltd, its staff, volunteers, or affiliates be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your attendance at the event, including but not limited to loss of profits, loss of enjoyment, or other intangible losses, even if advised of the possibility of such damages.
8. Force Majeure
- CHG&S and the event organizer shall not be held responsible for any failure to perform or any delays in the performance of obligations under these Terms and Conditions due to circumstances beyond their control, including but not limited to natural disasters, strikes, lockouts, civil unrest, government restrictions, or pandemics.
9. COVID-19 and Public Health Compliance
- Attendees must comply with any public health and safety regulations in place at the time of the event, including but not limited to mask-wearing, social distancing, or vaccination requirements. CHG&S reserves the right to refuse entry or service to any attendee who does not comply with such regulations.
10. Intellectual Property
- All rights related to the event, including but not limited to the performance, recordings, and visuals, remain the property of the event organizer and/or performers. Attendees are not granted any rights to reproduce or distribute content from the event without explicit permission from the event organizer.
11. Personal Data and GDPR Compliance
- By purchasing a ticket, you agree that CHG&S may collect and use your personal data in accordance with our Privacy Policy, and as required by the General Data Protection Regulation (GDPR). This includes using your contact information to communicate important updates regarding the event.
- Your data will not be shared with third parties, except for the event organizer, who may need to contact you regarding event-specific updates or changes.
12. Accessibility
- CHG&S is committed to providing an accessible venue for all attendees. If you have any specific accessibility needs, please contact us in advance so we can make the necessary arrangements.
13. Compliance with Irish Law
- These Terms and Conditions are governed by the laws of Ireland. By purchasing a ticket, you agree to comply with all applicable Irish laws and regulations during your attendance at the event.
14. Dispute Resolution
- Any disputes arising from these Terms and Conditions shall first be attempted to be resolved through mediation before escalating to legal action in the courts of Ireland.
